Terms of Service
Effective Date: April 16, 2026
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a binding agreement between you and MIZA LLC ("Company," "we," "us," or "our") regarding your use of the MIZA mobile application and website (collectively, the "Service"). By accessing, downloading, or using MIZA, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use our Service. We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to our website or within the app. Your continued use of MIZA constitutes acceptance of the modified Terms.
Age Requirement: You must be at least 13 years old to use MIZA. If you are under 18, you must have your parent or legal guardian's permission. By using MIZA, you represent and warrant that you meet these age requirements.
2. Account Creation and Responsibilities
2.1 Account Registration
- You are responsible for providing accurate, complete, and current information when creating your account
- You may create an account using email, Apple OAuth, or Google OAuth
- You must be 13 years or older to create an account
- One person, one account per email address (creating multiple accounts is prohibited)
2.2 Account Security
- You are solely responsible for maintaining the confidentiality of your account credentials
- You agree to immediately notify us of any unauthorized access or use of your account
- You are liable for all activities that occur under your account, whether authorized by you or not
- We are not liable for any loss or damage resulting from unauthorized account access
2.3 Account Termination
You may delete your account at any time through your account settings. Upon deletion:
- Your account will be deactivated within 24 hours
- Your personal information will be deleted within 30 days (see Privacy Policy)
- Your uploaded videos will be deleted within 30 days unless you provide written notice to retain specific content
- We are not responsible for recovery of deleted content
3. Content Ownership and Licensing
3.1 User-Generated Content
You retain all ownership rights to any content you create and upload to MIZA. By uploading content to our Service, you grant MIZA LLC a non-exclusive, royalty-free, worldwide license to:
- Store, process, and display your video content
- Transcode and optimize videos for delivery across devices
- Create thumbnails and preview images from your videos
- Distribute your content through the MIZA application and website
- Analyze usage patterns and improve our Service
This license is limited to operating the MIZA Service and does not grant MIZA any right to use your content for advertising, selling, or sublicensing to third parties without your express written consent.
3.2 Content Requirements
Upload Requirements:
- Maximum duration: 90 seconds per video
- Supported formats: MP4, MOV, WebM, and other standard video formats
- Maximum file size: 500MB per video
- You are responsible for ensuring sufficient storage and bandwidth on your device
3.3 Content Originality and Permission
You represent and warrant that:
- You own or have obtained proper permissions for all content you upload
- Your content does not infringe on any third-party intellectual property rights
- Your content does not contain music, images, or footage for which you lack proper rights or licenses
- If your video contains copyrighted music or third-party content, you have obtained written permission from the copyright holder
4. Prohibited Content
You agree not to upload, share, or transmit any content that:
- Is illegal or promotes illegal activity
- Is sexually explicit or contains child sexual abuse material (CSAM)
- Threatens, harasses, or bullies any person or group
- Contains violence or gore gratuitously or promotes harm
- Infringes intellectual property rights (copyright, trademark, patent, etc.)
- Contains hate speech targeting protected classes
- Is spam or misleading (misinformation, scams, phishing)
- Violates privacy by sharing others' personal information without consent
- Is defamatory or makes false accusations
- Promotes self-harm, suicide, or eating disorders
- Contains malware, viruses, or malicious code
- Impersonates another person or entity
5. Content Moderation and Removal
5.1 Our Rights
MIZA reserves the right to, at our sole discretion:
- Review, monitor, and remove any content that violates these Terms
- Suspend or terminate your account for violations
- Refuse service to any user without providing a reason
- Cooperate with law enforcement and provide information as required by law
5.2 Content Removal Procedure
If we remove your content:
- We will notify you of the removal and reason (if possible)
- You have 30 days to appeal by contacting support@miza.app
- Repeat violations may result in account termination
6. Digital Millennium Copyright Act (DMCA)
6.1 DMCA Notice
If you believe your copyright has been infringed by content on MIZA, you may submit a DMCA takedown notice. Your notice must include:
- Your name, address, email, and phone number
- A description of the copyrighted work you own
- A description of the infringing content and its location on our Service
- A statement that you have a good faith belief the use is not authorized
- Your signature (physical or electronic) under penalty of perjury
- A statement that the information is accurate and you are authorized to act on behalf of the copyright holder

6.2 Counter-Notification
If your content is removed due to DMCA, you may submit a counter-notification stating:
- You have a good faith belief the removal was erroneous
- You consent to jurisdiction of the Federal District Court in New Jersey
- You submit to service of process from the copyright claimant

6.3 Repeat Infringers
MIZA maintains a policy of terminating accounts of repeat copyright infringers in appropriate circumstances, as required by the Digital Millennium Copyright Act.
7. Limitation of Liability
DISCLAIMER: MIZA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE MAKE NO WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
7.1 No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
- We do not warrant that the Service will meet your requirements or expectations
- We do not warrant that videos will be processed without loss or corruption
- We do not warrant the accuracy, completeness, or reliability of any content
7.2 Limitation of Damages
IN NO EVENT SHALL MIZA LLC OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of data, revenue, profits, or business opportunity
- Loss of content or unauthorized access to your account
- Third-party claims or actions
MIZA's total liability for any claim shall not exceed $100 USD or the amount you paid for the Service in the 12 months preceding the claim, whichever is greater.
8. Indemnification
You agree to indemnify and hold harmless MIZA LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of or inability to use the Service
- Your violation of these Terms
- Your infringement of any third-party rights
- Any content you upload or transmit
- Your conduct on the Service
9. Acceptable Use Policy
You agree not to:
- Violate any applicable laws or regulations
- Engage in any form of abuse, harassment, or threats
- Attempt to gain unauthorized access to MIZA's systems or accounts
- Interfere with or disrupt the Service or servers
- Use automated tools, bots, or scrapers to access our Service
- Attempt to reverse engineer, decompile, or discover the source code
- Sell, rent, lease, or transfer your account or access to others
- Engage in any form of fraud, deception, or misrepresentation
- Spam or send unsolicited messages to other users
10. Intellectual Property Rights
10.1 MIZA's Intellectual Property
All content, features, and functionality of MIZA (excluding user-generated content) are owned by MIZA LLC and are protected by copyright, trademark, and other intellectual property laws. These include:
- The MIZA name, logo, and wordmark
- User interface design and layout
- Software code and algorithms
- Documentation and marketing materials
You are granted a limited, non-exclusive, non-transferable license to use MIZA solely for personal, non-commercial purposes.
10.2 User License Grant
You agree that your use of MIZA is strictly limited to viewing and sharing user-generated content. You may not:
- Modify, translate, or create derivative works
- Download or export content except as intended by the Service
- Remove any copyright or proprietary notices
11. Third-Party Links and Services
MIZA may contain links to third-party websites and services. We are not responsible for:
- The content, accuracy, or practices of third-party sites
- Your interactions with third-party providers
- Their privacy policies or terms of service
If you use OAuth authentication with Apple or Google, your interaction with those services is governed by their terms and privacy policies, not ours.
12. Termination and Account Suspension
12.1 Termination by MIZA
MIZA may immediately suspend or terminate your account and access to the Service if:
- You violate these Terms
- You engage in illegal activity
- You harm other users or MIZA's operations
- We believe in good faith your account poses a risk or liability
12.2 Effects of Termination
- Your access to the Service will be immediately revoked
- Your account and all associated content may be deleted
- You remain liable for any obligations incurred
- Your right to use MIZA terminates completely
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.
You agree to submit to the exclusive jurisdiction of the state and federal courts located in New Jersey for the resolution of any disputes. You waive any objection to venue or inconvenience of forum.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating formal legal proceedings, you agree to attempt to resolve disputes by contacting us at support@miza.app and providing us 30 days to resolve the issue.
14.2 Small Claims Court
Either party may pursue claims in small claims court in lieu of formal litigation, provided the claim is within the court's jurisdictional limits.
15. Export Control
MIZA is controlled in the United States and subject to U.S. export control laws. You agree not to access or use MIZA in violation of any U.S. export control laws or from countries subject to U.S. trade embargoes (including Iran, Syria, Cuba, North Korea, and the Crimea region).
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect. The invalid provision shall be reformed to the minimum extent necessary to make it valid.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MIZA regarding your use of the Service. Any prior agreements or understandings are superseded.
